1. Introduction

Welcome to Loire Antique, a website dedicated to the sale of carefully selected antiques. By accessing and using our website, you agree to these Terms and Conditions. If you do not agree to these terms, please do not use our site.

The purpose of these General Terms and Conditions of Sale is to define the rules applicable to the sale of products marketed on the online sales site (Contractual Terms and Conditions). We recommend that you read the general terms and conditions of our Loire-antique shop carefully, as by double-clicking on the order form you will be validating your irrevocable acceptance of the contractual terms and conditions.    
The Internet user (a natural person with the capacity to contract) and Loire Antique are hereinafter referred to as ‘the parties’, and individually as ‘the party’.
The purpose of these General Terms and Conditions of Sale is to define the rules applicable to the sale of products marketed on the Website (hereinafter referred to as ‘the Product(s)’),

Any natural person of legal age, who is not a trader, who has the legal capacity to enter into a contract, and who is domiciled exclusively in the countries supplied by Loire-Antique making a purchase of a product on the Website.
Loire-Antique reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The General Terms and Conditions of Sale applicable are those in force on the Site on the date the order is placed by the Customer; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Terms and Conditions of Sale in force at the time the order is placed

2. Access to the Site

Access to the site is free. Users must have an internet connection and compatible equipment to navigate Loire Antique. We cannot be held responsible for any access issues due to technical problems, interruptions, or updates. Access to the site is subject to the availability of online services.

3. Prices
The prices shown on the site are inclusive of all taxes (VAT not applicable, art 293 B of the CGI). Loire antique, as an auto-entrepreneur, is not subject to VAT. The prices of our products are indicated in euros € excluding shipping costs.
All orders, whatever their origin, are payable in EUR.
Loire Antique reserves the right to modify its prices at any time, with the exception of any sale of a product concluded for the price displayed on www excluding the ‘low price’. In the event of an obvious typographical error, leading to the display of a ‘low price’, the sale may be cancelled, as mentioned in the article ‘Execution of the order’. Delivery charges are payable by the customer. The different delivery options (together with their prices) are presented during the order process and specified during the order summary.
Products are invoiced on the basis of the prices in force at the time the order is placed, subject to availability. After completing the purchase order and before payment, the identification of the product will be presented to the customer, as well as the total price of the order (including delivery costs). In the event of delivery of products outside French territory, customs taxes and formalities are the sole responsibility of the Customer. In this case, the Customer undertakes to check whether the products ordered can be imported into the territory of the country of delivery.


 

4.-The products
Loire-Antique takes the greatest care in the presentation and description of the products to provide the Customer with the best possible information.
The Products offered for sale are those described on the Site on the day the Customer consults the Site, subject to availability. This information is updated in real time. In the event of a sale being made on a Product indicated as available by mistake, Loire-Antique will cancel your order and refund your order.
The products sold by Loire-Antique are second-hand products which may therefore have slight defects or signs of wear as specified in the description of the Product and/or the photographs of the Product. We are not experts, our description is sincere to the best of our knowledge.

5.-The Order
The order and order validation process comprises several stages during which the customer must validate a detailed summary of the order. By clicking on the ‘Validate’ button at the time of payment, the customer confirms the order and declares that he/she accepts these general terms and conditions of sale in full. This confirmation and all computer data recorded by Loire-Antique and, consequently, acceptance of said transactions.
Loire-Antique will send the customer an e-mail confirming receipt of the order and summarising the order. Loire-Antique reserves the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order. The information provided by the buyer when placing an order is binding: in the event of an error in the recipient's details, Loire-antique cannot be held responsible for the impossibility of delivering the product either definitively or within the delivery times indicated in these GTCS.
In the first case, the cost of returning the product to the purchaser (once the incorrect address has been corrected by the latter) will be entirely at the purchaser's expense; in the second case, the delay in delivery, caused by the transmission of an incorrect address, cannot be a reason for cancelling the order.

6.-Terms of Payment
Any order form signed by the Customer by ‘double-clicking’ constitutes an irrevocable acceptance which may only be challenged in the cases exhaustively provided for in this contract in the articles ‘Right of withdrawal’ and ‘Execution of the order’. The ordering process complies with the provisions of article 1369-5 of the French Civil Code.
- Any Internet user wishing to validate their order must identify themselves by filling in the appropriate form provided on www. This identification is carried out in strict compliance with the French Data Protection Act 78-17, as amended, as indicated in our ‘Data Protection’ section.
- After checking the contents of the order and its total cost (products ordered, shipping costs), and correcting any errors, the Internet user will confirm it definitively. This confirmation will be deemed to be the conclusion of the contract.
To pay for his/her order, the Customer may choose from all the payment methods referred to in the order process and presented on the company's website. He/she guarantees the company that he/she has the necessary authorisations to use the method of payment chosen by him/her when validating the order. In the case of payment by credit card, the customer must provide their bank card number, depending on the type of card, the expiry date and the cryptogram number (3-digit number on the back of the bank card). Loire-Antique guarantees hat payment is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data relating to payment methods as effectively as possible. The company guarantees that the encryption methods and services used to secure transactions have been authorised or declared in accordance with current legislation. In the case of payment by card, the provisions relating to fraudulent use of the means of payment set out in the agreements concluded between the Customer and the card issuer and between the company and its banking establishments apply, in accordance with article 132-4 of the French Monetary and Financial Code. If the only method of payment is by credit card, the order will be definitively validated upon payment in full (unless otherwise stipulated).
Products are payable in cash on the day the order is placed.
Several methods of payment are available to customers: 

- Bank card
The Customer accesses a dedicated area provided by a banking establishment, which ensures the security and recording of the payment order. In this respect, the Customer expressly acknowledges that the communication of their bank card number to Société Loire-Antique constitutes authorisation to debit their account for the amount of the products ordered.
- by cheque payable in France
By selecting this method of payment when entering your order on the site. Make your cheque payable to Loire-Antique, and print out the order confirmation e-mail. Enclose everything and send it by post to the address given to you. The order will be dispatched 7 days after the cheque has been credited to Loire-Antique's account
- Bank transfer directly to Loire-Antique's account
Your order will be processed on receipt of your bank transfer. An email confirming receipt of your transfer will be sent to you.
As soon as payment is received, Loire-Antique will process the order.
An invoice including VAT will be provided at the customer's request (VAT not applicable, art 293b of the CGI). If the customer encounters the slightest problem when making his/her purchases, he/she should send an e-mail to the following address: Loireantique@gmail.com.

7.-Delivery
The estimated delivery time for small items is 7 working days from receipt of payment. For furniture, the estimated delivery time is 4 weeks (variable depending on the carrier chosen). The modes of transport offered depend on the country of delivery.
Deliveries are made to the destinations proposed on the Site and operated by the service providers available according to the options proposed when the Order is placed. The delivery terms and conditions are indicated on the Site and vary according to the option chosen by the Customer.
Delivery refers to the transfer of physical possession of the Products to the Customer (the ‘Delivery’). The Delivery charges applicable to the Order are those indicated on the Site at the time the Order is placed.
The risk of loss or deterioration of the Product is transferred to the Customer at the time of Delivery. By way of exception, the risk is transferred to the Customer when the Product is handed over to the carrier if the Customer decides to use a carrier not offered on the Site.

Delivery shall be made to the delivery address indicated by the Customer, it being specified that this must be the Customer's home address.
In the event of it being impossible to carry out the Delivery, due to an incorrect delivery address or if the Customer does not collect the Products within the time limit set by the carrier, Loire-Antique reserves the right to charge a re-shipment fee.
The countries where delivery is accepted and the delivery times are indicated on the Site when the Order is placed, depending on the Customer's choice.
The Customer must ensure that they have provided accurate and complete information concerning the Delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).
The times indicated are indicative times, corresponding to average processing and delivery times. Loire-Antique cannot be held responsible for the consequences of a delay in delivery for which it is not responsible.
Upon receipt of a parcel, particularly for bulky items such as furniture, the customer is asked to carefully inspect the condition of the packaging and the product in the presence of the delivery person. If you notice any damage (damaged packaging, broken item), it is essential that you immediately make precise reservations on the delivery note. This is essential for any claim against the carrier.

It is possible that the parcel is damaged or that its contents have been partially or totally stolen. If you notice such an error, please mention it on the carrier's delivery note and refuse the product by sending it back to us accompanied by a 170 ‘spoliation report’. In accordance with article 133-3 of the French Commercial Code, you must send your complaint to the carrier by recorded delivery within 3 days (not including public holidays).
We would also remind you that without these reservations, the carrier cannot be held responsible and we cannot guarantee any compensation.
If a parcel is lost by one of our transport service providers, please inform Loire-antique as soon as possible. The company will make enquiries with the relevant departments.

8.-Right of withdrawal
Exchange and refund
In accordance with articles L121-16 and 121-20 of the French Consumer Code, the customer has a period of fourteen (14) clear days to exercise his right of withdrawal from the date of delivery, the items that do not suit you accompanied by the original invoice in the original packaging. The customer shall bear the full cost of returning the goods. Products must be returned in their original condition. It is also recommended that the products are returned in their original packaging, in a way that provides the same shipping guarantees as those defined when the products were initially shipped. The customer's right of withdrawal is null and void in the event of one of the following events occurring:
- damaged item (including packaging)
- incomplete item
- absence of the original packaging

9.-Applicable law
This contract is written in French and governed by French law. In the event of a legal dispute, the French courts shall have sole jurisdiction, in particular the courts of Angers.

10.-Information Technology and Civil Liberties
Loire-Antique undertakes not to divulge to third parties any information provided by the customer. This information remains confidential. It will only be used by our internal services to process the order and to reinforce and personalise communication, in particular through Loire-Antique newsletters to which the customer may have subscribed.
Consequently, and in accordance with Law No. 78-17 of 6 January 1978, relating to information technology, files and civil liberties, the customer has a right of access, rectification and opposition to personal data concerning him or her. To do this, they simply need to make a request online at loireantique@gmail.com
Finally, your bank details are never in our possession. Transactions are carried out via our partner Paybox's secure payment module.
In order to improve our service, the ‘ ’ site may use cookies. This enables you to avoid having to identify yourself each time you visit the site. A cookie is a computer file stored on your hard drive, enabling you to be recognised, with no time limit. You can, of course, delete these cookies by deactivating their use in your browser.

Responsibility
Loire-Antique is responsible for the proper performance of the obligations arising from the contract concluded at a distance, whether these obligations are to be performed by itself or by subcontractors, without prejudice to its right of recourse against the latter. Loire-Antique cannot be held responsible for the non-execution of the contract concluded, following the occurrence of an event of force majeure (as defined by the Law) and in particular in the event of total or partial strike of postal services, carriers, and disasters caused by floods or fires. This limitation of liability also applies to the non-performance of the said contract due to the unforeseeable and insurmountable fault of a third party unrelated to the supply of the services provided. With regard to products purchased to satisfy professional needs, Loire-antique shall not be held liable for any indirect damage, operating loss, loss of profit, damage or costs that may arise as a result of these products. The choice and purchase of a product or service are the sole responsibility of the customer. The total or partial impossibility of using the products, in particular due to incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the responsibility of loire-antique, except in the case of a proven hidden defect, non-conformity, defectiveness or exercise of the right of withdrawal.

Personal information
The information requested from the Customer is required to process the order and may be communicated to the company's contractual partners (accountants, lawyers....). It may also be passed on to any competent authority for the settlement of disputes between the company and one of its customers. Customers may consult our ‘data protection’ section for details of the personal data processing used via the www..com website. Customers may also exercise their rights of access, rectification and opposition in accordance with the procedures set out in the company's ‘Data Protection’ and ‘Legal Notice’ sections.

‘Double-click’ and proof
The ‘double click’ associated with the customer's authentication and non-repudiation procedure at the time of ordering and acceptance of these Contractual Terms and Conditions constitutes validation of the order and conclusion of the contract, in accordance with the provisions of article 1369-5 of the French Civil Code. The computerised registers, kept on the company's servers and on the servers of its banking establishments, will be considered as rebuttable presumptions of communications, orders and payments between the parties. Under no circumstances will the company record telephone conversations between a member of the company and one of its customers or prospects. In the event of subcontracting their customer service, the company undertakes to prohibit their partner responsible for implementing this service from making such recordings, including in the context of ‘service improvement’.
Conservation and archiving of documents
Transaction data is archived on a reliable and durable medium, in accordance with article 1348 of the French Civil Code. It is therefore carried out in compliance with the AFNOR Z 42-013 standard relating to the design and operation of computer systems with a view to ensuring the conservation and integrity of the records stored in these systems.

Entire contract
These general terms and conditions express the entirety of the obligations of the parties. No general or specific condition communicated by the Customer may be incorporated into these general conditions, except in the event of a prior agreement between the parties prior to the conclusion of the contract. The fact that the company does not take advantage of a breach by the Customer of any of the obligations referred to herein shall not be interpreted for the future as a waiver of the obligation in question. The company reserves the right to adapt or modify these Contractual Conditions at any time. In the event of modification, the Contractual Conditions in force on the day of the order will be applied to each order. The company will also keep on its servers all time-stamped versions of the Contractual Conditions.
Retention of title
The products delivered to the customer remain the property of the company until the contract has been fulfilled in full. On the other hand, the transfer of risks takes effect as soon as the products and/or services ordered on the e-shop are actually delivered. The documents supplied to the customer are governed by the French Intellectual Property Code. They therefore remain the property of the company. It is therefore forbidden to reproduce, transfer or exploit the documents supplied without the company's consent.
